Sell to UPGRADE Terms and Conditions

These terms and conditions apply to selling phones to UPGRADE on our website

If you are not a private individual, please, contact us at info@UPGRADE.me.

Please read these terms carefully before selling your phone to UPGRADE.

By filling in the sales form and selling your phone to UPGRADE, you agree to abide by UPGRADE’s terms

 

Definitions

 

  • UPGRADE: Refers to UPGRADE business ID 201866, Located at Hyper One, second floor, Al sheikh Zayed -Giza.
  • We: Refers to UPGRADE business ID 201866, Located at Hyper One, second floor, Al sheikh Zayed -Giza.
  • Our Website: refers to UPGRADE website www.upgrade.me
  • You: refers to the seller of the phone.
  • Terms and Conditions: refers to this page.
  •  Business Day: refers to business days excluding Fridays & Saturdays, Official holidays announced by the Egyptian government.
  • Phone: refers to the mobile phone you sell to UPGRADE.

 

The Seller

 

By selling your phone to UPGRADE, you agree to the following:

  • You are a private individual based in Egypt and legally capable of entering into a binding contract. 
  • Provide us with your contact information, including your valid ID (Egyptian ID or a valid passport if you are a foreigner), active telephone number, and email address.
  • You are solely responsible for the accuracy of the information you provide UPGRADE and are liable for any costs caused by giving incorrect contact information.
  • You must be of the required legal age to sell and profit from the phone. If you are under the legal age; you cannot sell your phone to UPGRADE.
  • Give UPGRADE full rights to investigate the phone for missing parts or damage. it may require UPGRADE experts to open the mobile phone physically.
  • Your data is stored in UPGRADE's customer register and used to maintain and manage customer relationships.

Sell to UPGRADE Terms

 

1.1 To sell your smartphone to UPGRADE, you must:

  • Follow the “Sell” process on the UPGRADE website and provide us with accurate information about your mobile phone brand, external appearance, and technical specifications.
  • Sell only authentic Apple and Samsung smartphones and specific models as defined on the Sell page on our website.
  • Ensure that your mobile phone meets our required quality standards.
  • Erase all data from your phone. 

Note that this will erase all data from your phone. UPGRADE will not take responsibility for any data not erased on the mobile phone however, we perform professional data wiping using certified tools.

  • Turn Off the “Find My iPhone” or “Find My Mobile” feature, otherwise, UPGRADE has the right to reject the sale.
  • You can revoke your offer by canceling the order until you visit our store.

Once you submit your sale request, we will:

  • Give you an estimated price on our website to buy your mobile phone, provided that the mobile phone corresponds to the description you made.
  • We will schedule a visit to our nearest store to inspect your mobile phone. During this inspection, we may make minor changes to the item, such as removing personal dedications, stickers, or addresses; removing own protective sleeves/bindings; opening shrink-wrapped or original packaged products and accessories; attaching a removable sticker (object ID); removing protective films and embellishments; and ridding of dirt.

 

1.2 Sale Offer to UPGRADE Validation:

  • You have 7 days from submitting your sale request to visit our store to handle the mobile phone you are offering for sale. After that time, UPGRADE has the right to update the price based solely on its discretion.
  • If the product and its properties match your description, our offer to buy it from you is valid with the estimated price previously shown to you on our website.
  • If the inspection of your smartphone reveals that the actual condition differs from the condition that you described, we will withdraw the offer and propose an adjusted price based on our criteria and the condition of the mobile phone.
  • You reserve the right to accept or reject our offer to buy your mobile phone.

 

UPGRADE has the right to reject the sale in the following cases:

  • Detect suspicious activity or suspect fraud.
  • Defective product, Water damaged, bent, or have problems suggestive of the motherboard.
  • Blacklist mobile phones (a reported stolen or lost phone).
  • MDM-locked Phones (mobile devices that are managed by corporate security software. 

These devices are typically owned by businesses or corporations, and the software allows these businesses to track and control the device).

  • Device lock/power up logo to a specific network operator.
  • Software/Firmware rooting
  • Unlocking: unofficial unlocking for Google account/Samsung account/Apple ID or operator lock.

If you want to sell us several mobile phones, we’ll include a separate purchase contract for each product.

If you offer us the same product several times or a vast number of products from the same product category, we expressly reserve the right to make the acceptance of your offer dependent on the prior submission of proof of ownership for the products offered. The same applies if you offer us many products for sale that are generally unusual for consumers. The same applies if you create an unusually high number of individual orders. If we exercise this right, our customer service team will contact you.

Notwithstanding the above, we are entitled to make you a new offer (counter-offer) for each product, reject your sale, or classify you as a commercial customer.

 

 

Device Ownership and declaration form

 

  • The mobile phone ownership is immediately transferred to UPGRADE upon receiving your payment.
  • Once you accept our offer at our store, you must sign a declaration form confirming that you are the rightful owner of the phone, the phone is in good working order, and that you have not reported the phone as lost or stolen.
  • Your name on the declaration form must be exactly as your ID.
  • Your ID must be valid.
  • You don’t have the right to request a cancelation after processing the payment.

 

Limitation of Liability

 

Nothing in these terms shall exclude or limit UPGRADE's liability concerning any matter for which it would be unlawful for us to limit or exclude our liability.

  • UPGRADE is not liable for any indirect costs that are a side effect of the loss of profit, opportunity, and damage.
  • UPGRADE is also not liable for failure to deliver products or meet any other obligations under these terms if such failure is due to an event that is beyond our reasonable control, such as fire, flood, storm, riot, civil disturbance, war, nuclear accident, terrorist activity, strikes, epidemics, or quarantine.
  • UPGRADE's maximum liability to you for any loss or damage arising in connection with the service shall be limited to the total price of the phone or your order. The product liability for defects is limited to the possible refund of the product value based on its condition when UPGRADE receives it.

 

Updates on Terms & Conditions

 

UPGRADE reserves the right to change or amend the terms and conditions without prior notice to you.

The latest version of the terms and conditions announced on the UPGRADE website will be accredited at the time of placing your order, please read them carefully.

 

Applicable Law and Dispute Resolution

 

These Terms and conditions are governed by Egyptian law.
